General

1.1 These general terms and conditions apply to every offer from PROFESSOR.NL and to every agreement concluded PROFESSOR.NL The conditions are accessible to everyone and included on the PROFESSOR.NL . We will send you a written copy upon request.

1.2 By placing an order you indicate that you agree to the delivery and payment terms. PROFESSOR.NL reserves the right to change its delivery and/or payment terms after the term has expired.

1.3 Unless otherwise agreed in writing, the general or specific terms and conditions or stipulations of third parties are not recognized by PROFESSOR.NL .

1.4 PROFESSOR.NL guarantees that the delivered product complies with the agreement and meets the specifications stated in the offer.

Delivery

2.1 Delivery takes place while stocks last.

2.2 In the context of the rules of distance purchasing, PROFESSOR.NL execute orders at least within 30 days, unless a different delivery period has been agreed. If delivery within 30 days or otherwise agreed delivery time is not possible (because the ordered item is out of stock or no longer available), or there is a delay for other reasons, or an order cannot or can only be partially executed, the consumer will receive within 1 month after placing the order and in that case he has the right to cancel the order without costs and notice of default.

2.3 PROFESSOR.NL 's delivery obligation will, unless proven otherwise, be fulfilled as soon as the goods delivered by PROFESSOR.NL have been offered to the customer. In the case of home delivery, the carrier's report, containing the refusal of acceptance, serves as full proof of the offer of delivery.

2.4 All delivery times stated on the website are indicative. Therefore, no rights can be derived from the stated periods.

Prices 3.1 Prices will not be increased within the term of the offer, unless legal measures make this necessary or if the manufacturer implements interim price increases.

3.2 All prices on the site are subject to printing and typographical errors. No liability is accepted for the consequences of printing and typographical errors.

3.3 All prices on the site are in Euros and include 21% VAT.

Inspection period / right of withdrawal

4.1 If there is a consumer purchase, in accordance with the Distance Selling Act (Article 7:5 of the Dutch Civil Code), the customer has the right to withdraw (part of) the delivered goods within a period of 14 working days without giving any reason. return. This period starts when the order is delivered. If the customer wishes to cancel the order after placing it, the customer can make this known via email or contact form.

If PROFESSOR.NL is informed in time and has not yet processed the order, PROFESSOR.NL will refund the full amount to the customer and cancel the order. If PROFESSOR.NL has already processed the order, PROFESSOR.NL reserves the right to charge processing costs.

Before returning the product, the customer is obliged to notify PROFESSOR.NL in writing within 14 working days of receipt, to indicate the intention to return. PROFESSOR.NL will then provide clear instructions.

If the customer has not reported anything within the trial period of 14 days after receipt, the statutory right of return will lapse and the purchase will be a fact.

During the cooling-off period, the consumer will handle the product and packaging with care. He will only unpack the product to the extent strictly necessary to assess the nature and characteristics of the product if he wishes to exercise his right of withdrawal.

The customer must prove that the delivered goods have been returned on time, for example by means of proof of shipment. Since it is impossible to prove what is in the shipment, PROFESSOR.NL cannot refund the money on the basis of proof of shipment.

The goods must be returned in the original packaging (including accessories and associated documentation) and in new condition. If the goods have been opened by the customer or have been damaged in any way, PROFESSOR.NL the right to charge a reduction in value.

Subject to the provisions of the previous sentence, PROFESSOR.NL will make a refund within 14 days of receipt of the return shipment.

If the purchase is returned unopened, according to the instructions of PROFESSOR.NL , the purchase amount excluding € 15 administration & processing costs will be refunded to the customer.

If only part of the purchases received are returned, only the purchase value of the returned items will be refunded, please note that an administration/processing fee of €15 will also be deducted.

Additional costs resulting from a more expensive shipping method than the cheapest standard delivery will never be refunded. Returning the delivered goods is entirely at the expense and risk of the customer.

4.2 The right of withdrawal does not to:

5.2 PROFESSOR.NL respects the privacy of the users of the website and ensures confidential treatment of your personal data.

Warranty / complaints and conformity

6.1 PROFESSOR.NL guarantees that the products and/or services comply with the agreement, the specifications stated in the offer, the reasonable requirements of reliability and/or usability and the date of conclusion existing legal provisions and/or government regulations of the agreement.

6.2 A scheme offered as a guarantee by PROFESSOR.NL , manufacturer or importer does not affect the rights and claims that the consumer can assert towards the customer with regard to a shortcoming in the fulfillment of PROFESSOR.NL 's obligations on the basis of the law and/or the distance contract.

6.3 If it appears that the delivered goods are incorrect, defective or incomplete, the customer must (before returning to PROFESSOR.NL ) report these defects in writing to PROFESSOR.NL within 30 days of receipt.

Returns of the goods must be made in the original packaging (including accessories and associated documentation). If the delivered goods are opened and no longer complete before the defect was discovered, damage occurred after the defect was discovered, encumbrance and/or resale after the defect was discovered, this right to complain and return expires completely.

6.4 If complaints from the customer are found to be well-founded by PROFESSOR.NL , PROFESSOR.NL will repair, resend or replace the delivered goods free of charge at the consumer's option.

Any liability of PROFESSOR.NL for damage is limited to a maximum of the invoice amount of the goods in question, or (at PROFESSOR.NL 's option) to the maximum amount covered in the relevant case by PROFESSOR.NL 's liability insurance. Any liability of PROFESSOR.NL for any other form of damage is excluded, including additional compensation in any form, compensation for indirect damage or consequential damage or damage due to lost profits.

6.5 Supplement - Complaints procedure

Complaints about the execution of the agreement must be submitted fully and clearly described to PROFESSOR.NL after the consumer has discovered the defects.

Complaints submitted to PROFESSOR.NL will be answered within 14 days from the date of receipt. If a complaint requires a foreseeably longer processing time, PROFESSOR.NL will respond within 14 days with an acknowledgment of receipt and an indication of when the consumer can expect a more detailed answer.

If the complaint cannot be resolved through proper consultation, a dispute arises that is subject to the dispute settlement procedure.

In case of complaints, a consumer should first contact PROFESSOR.NL . For complaints that cannot be resolved through proper consultation, the consumer should contact Stichting WebwinkelKeur (webwinkelkeur.com), which will mediate free of charge. If a solution has not yet been reached, the consumer has the option to have his complaint handled by an independent dispute committee appointed by Stichting WebwinkelKeur, the decision of which is binding.

Both PROFESSOR.NL and the customer agree to this binding statement. Submitting a dispute to this dispute committee involves costs that the consumer must pay to the relevant committee. It is also possible to register complaints via the European ODR platform (http://ec.europa.eu/odr).

A complaint does not suspend PROFESSOR.NL 's obligations, unless PROFESSOR.NL indicates otherwise in writing. If a complaint is found to be justified by PROFESSOR.NL , PROFESSOR.NL will, at its option, replace the delivered products free of charge.

6.6 PROFESSOR.NL is not liable for damage caused by intent or equivalent deliberate recklessness of non-managerial staff. This warranty does not if;

Offers

7.1 Offers are without obligation, unless stated otherwise in the offer.

7.3 Oral commitments only bind PROFESSOR.NL after they have been expressly confirmed in writing.

7.4 Offers from PROFESSOR.NL do not automatically apply to repeat orders.

7.5 PROFESSOR.NL cannot be held to its offer if the customer should have understood that the offer, or part thereof, contained an obvious mistake or typo.

7.6 Additions, changes and/or further agreements are only effective if agreed in writing.

Agreement

8.1 An agreement between PROFESSOR.NL and a customer is concluded after an order has been assessed for feasibility by PROFESSOR.NL .

8.2 PROFESSOR.NL reserves the right not to accept orders or assignments without giving reasons or to only accept them under certain conditions.

If it is made known to PROFESSOR.NL in any way that the customer does not respect or comply with the safety regulations of the goods offered on the site, PROFESSOR.NL is forced to block the customer's account and cancel further transactions in the future. point or refund.

Images and specifications

Force majeure

However, this does not apply if the part already delivered or deliverable has no independent value.

Liability

11.1 PROFESSOR.NL is not liable for damage to objects caused by incorrect use of the products. Before use, read the instructions on the packaging and/or consult our website.

Retention of title

12.4 The customer now gives unconditional and irrevocable permission to PROFESSOR.NL or a third party to be appointed by PROFESSOR.NL , in all cases in which PROFESSOR.NL wishes to exercise its ownership rights, to enter all those places where its property will be located. and take those things there with you.

12.5 If third parties seize the goods delivered under retention of title or wish to establish or enforce rights thereon, the customer is obliged to inform PROFESSOR.NL of this as soon as can reasonably be expected.

Applicable law/competent court

13.1 Dutch law applies to all agreements.

13.2 Disputes arising from an agreement between PROFESSOR.NL and the buyer, which cannot be resolved by mutual agreement, will be dealt with by the competent court within the district of Rotterdam, unless PROFESSOR.NL prefers to submit the difference to the competent court. of the buyer's place of residence, and with the exception of those disputes that fall within the jurisdiction of the subdistrict court.
